Terms of Use

These Terms of Use govern your use of the websites owned and operated by Fight for the Future, including www.fightforthefuture.org, www.battleforthenet.com, www.banfacialrecognition.com, and www.dataprivacynow.org (the “Websites”). For purposes of this policy, “Fight for the Future” includes Fight for the Future and Fight for the Future Education Fund, as well as their respective employees, and any third-party partners or licensors that contribute resources, information and/or data to our Websites. So when we say “we,” “us,” or “our,” we are referring to all of the parties identified in the preceding sentence. When we say “you,” we’re talking about you and everyone like you who uses our Websites.

By accessing or using any of the Websites, you agree to these Terms of Use, as well our Privacy Policy. If you do not agree to these terms, please do not access or use any of our Websites. We may update these Terms of Use from time to time upon posting a revised version on the Websites. By continuing to use the Websites after the posting of updated Terms of Use, you agree to the terms as amended.

USE OF OUR WEBSITES

You may use the Websites solely in accordance with these Terms of Use and solely for your personal, noncommercial use. You may make copies of any part of the Websites in any medium to use for noncommercial purposes. You must obtain our prior consent to use any of the content on the Websites for any other purpose.

USE OF SUBMISSION TOOLS

We may permit you to post, upload, transmit and otherwise submit comments, messages, and other content and materials (“Submissions”) on or through online petition pages, “Contact Us” pages, and other pages of our Websites. You acknowledge that Submissions may be routed through our servers, the servers of one or more third parties, and the internet, may be viewed by our employees, and, if your Submission is made in connection with a petition, proceeding, or other advocacy initiative, may be submitted to state and/or federal lawmakers or one or more U.S. government agencies and may be entered into the public record.

If you are submitting a comment to a U.S. government agency on one of our Websites, you acknowledge that there may be a delay between the time you hit the “Submit” button and the time your comment appears in the public record. Due to the nature of open comment periods, a single individual may be able to submit multiple comments in the same proceeding. To prevent any one person from submitting an undue number of comments, our system may prevent multiple comments. Many forms of writing receive copyright protection at the moment of their creation. As such, you retain the copyright and other ownership rights you may have in any Submissions that you make on or through the Websites. However, you grant us and our licensees a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use your Submissions for their intended purpose and as described in our Privacy Policy.

For any Submissions you make on or through our Websites, you agree to abide by the following rules:

You may not make any Submissions under a false name (i.e., a name other than your birth name or the name by which you are commonly known, if not your birth name) or a false email address. You may not impersonate another user or provide any false information about yourself. Some agencies permit anonymous filings, so if you are concerned about privacy file under “anonymous.”
Your Submissions may not include any material, or any links to material, that is libelous, defamatory, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law, harmful to children, in violation of third-party privacy rights, or that constitutes hate speech or a personal attack.
You may only submit content and materials for which you have the copyright or other necessary rights and permissions to distribute electronically. You may not plagiarize content or violate or infringe on the rights of third parties, including copyright, patent, trademark, trade secret, privacy, personal, publicity, moral or proprietary rights. You promise and represent that you own or have all necessary rights and permissions to use, distribute and authorize us and our licensees to use your Submissions for their intended purpose.
Your Submissions may not contain any solicitation of funds, advertising, promotion, solicitation for goods and services, or recruiting.

You are solely responsible for your Submissions. We do not and cannot review all Submissions by you or others and we will not be responsible for any Submissions made by you or others on or through the Websites. We cannot verify the accuracy of statements that users of our Websites make on or through the Websites or in their Submissions, and we cannot guarantee that all Submissions are in compliance with these Terms of Use. However, we reserve the right (but do not have the obligation) to review Submissions to verify their compliance with these Terms of Use.

PROHIBITED ACTIVITIES

You may not collect or harvest any personally identifiable information from any of the Websites or use the communication systems provided by any of the Websites for any commercial solicitation purposes. You agree not to solicit any users of any of the Websites for any commercial purposes or to use any of the Websites for any unlawful or fraudulent activities.

LINKS TO THIRD PARTY WEBSITES

Our Websites may include links to third party websites. We do not intend links on our Websites to be referrals or endorsements of the linked entities – they are provided for convenience only – and we have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites. Access and use them at your own risk.

DISCLAIMER

The Websites are provided “AS IS,” without warranties of any kind. You agree that your use of the Websites is at your sole risk. to the fullest extent permitted by law, we and our officers, directors, employees, and agents disclaim all warranties, representations, conditions, and guarantees of any kind, either expressed or implied, including any implied warranties, representations, conditions, or guarantees of quality, merchantability, fitness for a particular purpose, or non-infringement, and including any warranties or representations about the accuracy or completeness of the Websites or of any sites linked to or from the Websites. We make no warranty, representation or guaranty as to the content, sequence, accuracy, timeliness or completeness of the information on the Websites, or that the information may be relied upon for any reason, or that the Websites will be uninterrupted or error free.

LIMITATION OF LIABILITY

Under no circumstances will we be liable for any losses or damages whatsoever, whether in contract tort, or otherwise, arising from your use of, or reliance on, the Websites or any information contained therein. Without limiting the generality of the foregoing, we will have no liability for:

any damage to your computer hardware, data, information, materials and/or business resulting from the information on the Websites, or the lack of information available on the Websites;
any loss or injury caused, in whole or in part, by our actions, omissions, or negligence, or for contingencies beyond our control, in procuring, compiling, or delivering the Websites;
any errors, omissions, or inaccuracies in the information contained in the Websites, regardless of how caused, or delays or interruptions in delivery of the Websites or the information contained therein; or
any decision made or action taken or not taken in reliance upon the Websites or any information contained therein.

These limitations of liability will apply to the fullest extent permitted by law in the applicable jurisdiction.

INDEMNITY

You agree to defend, indemnify and hold harmless Fight for the Future, and our officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) your use of and access to any of the Websites; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right or any law, including any copyright, property, or privacy right; or (iv) any claim that any Submissions you make via the Websites violate any third party right or any law. This defense and indemnification obligation will survive even after you have stopped using the Websites.

ABILITY TO ACCEPT TERMS OF USE

You affirm that you have reached the age of majority in your jurisdiction or possess legal parental or guardian consent and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.

MISCELLANEOUS

These Terms of Use will be governed by the laws of the State of Massachusetts, without regard to its conflict of laws principles, and, where applicable, the laws of the United States. These Terms of Use, together with the Privacy Policy and any other legal notices published by us on the Websites, will constitute the entire agreement between you and us concerning the Websites. If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of these Terms of Use, which will remain in full force and effect. No waiver of any term of this these Terms of Use will be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms of Use will not constitute a waiver of such right or provision. These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be transferred or assigned by us without restriction. YOU AND FIGHT FOR THE FUTURE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
